Brand Content Terms
2026-10-23
Provisional version (brand-content-terms-draft-2026-10-23, 23 October 2026). A revision will be posted here as a new version and applies to claims and submissions made after it.
1. Scope
These terms apply to the following content (“Brand Content”) that a brand or its agent (the “Brand”) submits through the Modern-G brand portal:
images;
links to, and embeds of, videos (YouTube, Vimeo);
text: the official product name and model number, specifications, a product description, official and support URLs, and availability.
Modern-G's editorial articles, reviews, ratings and affiliate links are outside these terms. A Brand cannot change them.
2. Acceptance
The Brand accepts these terms each time it submits content. We record the terms version (termsVersion), the time, the account and the scope chosen for each image.
The person accepting confirms that they are authorised to accept on the Brand's behalf. An agency accepts under written authorisation from the Brand.
3. Brand warranties
The Brand warrants that:
1. it owns the content, or is authorised to license it under these terms;
2. it has the consent needed for any person shown (likeness and publicity rights);
3. it has the permissions needed for third-party marks, logos and works, and for any music in its videos;
4. the product information (specifications, price, availability and so on) is accurate and not misleading, including under Japan's Act against Unjustifiable Premiums and Misleading Representations and the Pharmaceuticals and Medical Devices Act. The Brand will update it promptly when something important changes.
4. Indemnity
If a third party makes a claim against Modern-G because the Brand breached a warranty in section 3, the Brand will cover Modern-G's reasonable losses, including reasonable legal fees. Modern-G will tell the Brand promptly about the claim and cooperate in handling it.
5. Licence
1. The Brand grants Modern-G a non-exclusive, royalty-free, worldwide licence to use the Brand Content within the scope in section 6.
2. The licence covers display, and the technical processing display needs: resizing, cropping, format conversion, compression and thumbnails. Modern-G makes no other change that alters the content's meaning (no added text, compositing or edits to what is shown).
3. Modern-G may adjust the layout of text for display and shorten it to fit length limits. It does not change the meaning.
4. Videos are shown through the YouTube or Vimeo embedded player. Modern-G does not copy or store video files.
5. Modern-G does not use portal uploads to train AI models, and does not give them to anyone else for that purpose. It also does not use them as material for AI-written articles.
6. Copyright and other rights stay with the Brand (or the rightful owner). These terms transfer no rights.
6. Where content is used
Brand Content is used to present the product concerned in:
Modern-G product pages;
category cards and the homepage;
link previews when a page is shared, for example on social media (OG images and link cards);
the Modern-G newsletter, only if the Brand chooses it.
For each image, the Brand chooses one scope:
| Scope | Covers | System value |
|---|---|---|
| Modern-G site | everything above except the newsletter | modern-g-site |
| Site and newsletter | everything above | modern-g-site-and-newsletter |
Text and videos have no scope choice. They are shown on the Modern-G site.
7. Attribution and labels
Where practical, images are credited “Image: brand name”. The credit may be left out where it can't be shown, for example on small thumbnails or OG images.
Text submitted by the Brand is labelled 「ブランド公式情報」 (“Official brand information”) and shown separately from editorial articles and reviews.
8. Modern-G decides what is shown
1. Modern-G decides whether and how Brand Content is shown. Submitting content does not guarantee publication.
2. Submitted content goes through automated checks: file type and size, duplicates, link safety, official domain, conflicts with verified specifications, and exaggerated or medical claims. Content that fails a check is not shown, and Modern-G staff may review it.
3. The Brand never sets or changes a product's cover (lead) image. Brand images are added after the existing images. If a product has no image yet, a Brand image stays hidden until staff review it.
4. Modern-G may stop showing or remove any Brand Content at any time, without giving a reason.
9. Editorial independence and paid placement
Brand Content is shown separately from Modern-G's editorial articles and reviews.
Submitting content, or buying newsletter placements, never changes Modern-G's editorial judgement, ratings, affiliate links or ranking.
Claiming a product and submitting Brand Content are free. Payment is never required. Paid newsletter placements are governed by the Advertising & Refund Policy.
10. Withdrawal and takedown
1. The Brand can withdraw any content at any time in the portal.
2. Modern-G removes withdrawn content from the live site within 5 business days of the request (target).
3. Modern-G cannot recall newsletters already sent, third-party caches, previews already shared on social media, or search engine results. Copies in backups are deleted on the normal backup cycle.
4. Third-party rights complaints: anyone who believes content infringes their rights can write to info@gloture.co.jp. Modern-G may hide the content while it reviews the complaint, and will tell the Brand when it does.
11. Personal data
1. What we collect from people who upload or apply: name, work email, company, role, IP address (hashed) and user agent for security, and, for agencies, the Brand's written authorisation.
2. Why: to confirm identity and authority to represent the Brand, to review and show Brand Content, to contact you about the portal, to prevent abuse, and to handle disputes.
3. How long:
• account details: while the account is active, plus 12 months;
• authorisation documents: 12 months after the claim decision, or 12 months after the agency relationship ends, whichever is later;
• acceptance records (termsVersion, time, scope): for the life of the licence, plus 5 years;
• IP address (hashed) and user agent: 90 days;
• claims not approved: 12 months.
4. Access is limited to Modern-G staff who review brand applications.
5. Image metadata: EXIF data, including location (GPS), is removed from images on upload.
6. Law: we handle personal data under Japan's Act on the Protection of Personal Information (APPI). Our service providers (hosting, database, file storage, email delivery) include companies outside Japan, such as in the United States. See the Privacy Notice (https://modern-g.com/en/submit/privacy).
7. Requests for access, correction, deletion or suspension of use: info@gloture.co.jp.
12. Term and ending
These terms apply from the Brand's first submission until the account is closed or all content is withdrawn.
Modern-G may suspend an account for a breach of these terms, or if it cannot confirm the person's authority to represent the Brand.
Sections 3 (warranties), 4 (indemnity), 10.3 and 14 continue after the terms end.
13. Changes to these terms
A changed version gets a new termsVersion and is announced in the portal.
The Brand must accept the new version before its next submission.
Content already submitted stays under the version accepted for it until the Brand accepts the new version.
14. Governing law and courts
These terms are governed by Japanese law. The Tokyo District Court has exclusive jurisdiction in the first instance. If the Japanese and English versions differ, the Japanese version prevails.
